These Terms of Service ("Terms") apply to your use of discountkings.net (the "Site") and to every quote, order and purchase from Discount Kings ("Discount Kings," "we," "us"). By using the Site, creating an account, requesting a quote or placing an order, you agree to these Terms and to our Refund & Cancellation Policy and Privacy Policy, which are part of them. If you do not agree, please do not use the Site.
1. Who we sell to
We sell lighting, electrical and related products to businesses, contractors, institutions and individuals in the United States. You must be at least 18 years old and able to enter into a binding contract. If you order on behalf of a company or other organization, you confirm that you are authorized to bind it to these Terms.
2. Accounts and customer pricing levels
- You sign in with a one-time code sent to your email address. You are responsible for keeping that email account secure and for all activity under your account.
- The information you give us must be accurate and kept up to date.
- Some pricing levels (Reseller / Contractor, SLED (State, Local Gov & Education), Distributor) require our approval and may require proof of eligibility, such as a business or contractor license, resale certificate or proof of agency. We may approve, decline, change or remove a pricing level at any time.
- Account pricing is for your own organization's purchases. Do not share your sign-in or your pricing with others.
- We may suspend or close an account that is misused or that violates these Terms.
3. Product information
Product descriptions, specifications, photos, spec sheets and other technical documents on the Site come from the manufacturers. We work to keep them accurate, but manufacturers change products without notice and errors can occur. The manufacturer's current published specification controls. Photos are for illustration; color and finish can look different on your screen.
Certifications and listings (for example UL, ETL, DLC, ENERGY STAR, Title 24) and any rebate, energy-savings or payback information are provided for convenience only. Listings change, and rebates are decided by the utility or program — not by us. Confirm current eligibility before you rely on it. We do not guarantee any rebate or savings amount.
4. Prices, quotes and errors
- Prices are in U.S. dollars and can change at any time before we accept your order. Items shown as "Call for pricing" must be quoted.
- Prices do not include shipping, freight services (such as liftgate or residential delivery) or sales tax unless we say so.
- Written quotes are valid for 30 days unless the quote states a different date, and are subject to manufacturer price changes and availability.
- If a price or description is clearly wrong because of a typographical or system error, we may correct it and cancel or re-quote the order, even after you receive an order confirmation. If you already paid, we will refund the amount paid for the affected items.
5. Orders
Your order is an offer to buy. An automatic confirmation email means we received your order — it is not our acceptance. We accept an order when we ship it or confirm it in writing. We may decline or limit any order, including for availability, suspected fraud, credit concerns or pricing errors. Many items ship from the manufacturer; stock and lead times are estimates and are not guaranteed. We are not liable for delays caused by manufacturers, carriers or events beyond our reasonable control.
6. Payment
- We accept major credit and debit cards and ACH bank transfers through our third-party payment processor. Your card and bank details are sent directly to the processor; we do not store them.
- By submitting payment you confirm you are authorized to use the payment method and you authorize us to charge the order total.
- ACH payments take several business days to clear. We may hold an order until the payment has cleared. Returned or reversed payments may be subject to a fee and collection costs as allowed by law.
- Credit terms (for example net 30) are available only with our written approval.
7. Sales tax and tax-exempt purchases
We charge sales tax where the law requires it. If your purchases are exempt, you must give us a valid exemption certificatebefore you order — see Tax-Exempt Accounts. You are responsible for any tax, penalties and interest if a certificate you provide is invalid, expired or does not apply to a purchase.
8. Shipping, title and risk of loss
- Delivery dates are estimates. We may ship an order in more than one shipment.
- Title and risk of loss pass to you when the products are handed to the carrier, unless we have agreed otherwise in writing.
- Inspect every delivery when it arrives. Note visible damage or missing cartons on the carrier's delivery receipt before signing, and tell us within 5 business days of delivery. See the Refund & Cancellation Policy.
9. Returns, refunds and cancellations
Returns, refunds and cancellations are covered by our Refund & Cancellation Policy. No product may be returned without a return authorization from us.
10. Warranty
Products are covered by the manufacturer's warranty, if any. As an authorized distributor we will help you make a warranty claim with the manufacturer. The manufacturer's warranty terms decide the remedy (repair, replacement or credit) and normally do not cover labor, removal, reinstallation, lifts or other costs.
Except for the manufacturer's warranty, products and the Site are provided "as is." To the fullest extent allowed by law,Discount Kings disclaims all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
11. Installation and use
Electrical products must be installed by a qualified, licensed electrician in accordance with the manufacturer's instructions, the National Electrical Code and all local codes. You are responsible for selecting products that are suitable for your application and for confirming code compliance. Layouts, product suggestions, cross-references and payback estimates we provide are a courtesy and are not engineering advice.
12. Limitation of liability
To the fullest extent allowed by law, Discount Kings will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost savings or rebates, downtime, labor or reinstallation costs, arising from the Site, any product or any order. Our total liability for any claim will not be more than the amount you paid us for the product that gave rise to the claim.
Some states do not allow certain limits, so some of these limits may not apply to you.
13. Indemnity
You agree to defend and hold Discount Kings harmless from claims, losses and costs (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or the improper installation, modification or use of products you purchase.
14. Using the Site
- Do not use the Site for anything unlawful, attempt to break or probe its security, interfere with its operation, or collect its content with automated tools without our written permission.
- The Site's design, text and software belong to Discount Kings. Manufacturer names, logos, photos and documents belong to their owners and are used with permission. You may view and print pages for your own purchasing and project use.
- Links to other websites are provided for convenience; we are not responsible for their content.
- If you send us ideas or feedback, we may use them without obligation to you.
15. Privacy
Our Privacy Policy explains what information we collect, how we use it and who we share it with. We do not sell your personal information.
16. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute will be brought only in the state or federal courts serving Fulton County, Georgia, and you consent to those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any claim must be brought within one year after it arises, to the extent the law allows.
17. Changes and general terms
- We may update these Terms by posting a new version here. The version posted when you place an order applies to that order.
- These Terms, our Refund & Cancellation Policy and any written quote or agreement signed by us are the entire agreement between us. Terms on your purchase order or other documents that add to or conflict with these Terms do not apply unless we agree in writing.
- If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver of it.
